Such suspension or access restriction may be implemented by enamorix.com immediately and without any warning, notice or refund. enamorix.com may suspend the user's account and in some cases request clarification, conduct an investigation or request that the user clarify their actions and provide additional information. If the user's account has been suspended, the user must contact us for more information. enamorix.com may suspend the user's account for a reasonable period of time before we permanently terminate a user's account.
3.9 Delete user accounts that have been inactive for more than six (6) months, any outstanding credits and content in the user account will be deleted and will not be available again. To become a member again, the user needs to create a new user account. The term inactive means that the user has not logged into their user account during the specified time period of six (6) months.
Responsibility:
4.1 enamorix.com does everything we can to prevent the service from experiencing technical disruptions when the user uses the service. However, enamorix.com cannot be held responsible for technical interruptions, complications, measures, changes to the platform, usability, force majeure events or other causes that affect access to the service.
4.2 enamorix.com takes law and regulation very seriously, therefore enamorix.com has developed a procedure whereby all images and texts uploaded to a user's profile are manually reviewed before they are published on the website. enamorix.com does this to discourage and protect our users from uploading illegal material. However, should there be material, or other activity that is questionable, please see Section 11, Reporting Illegal Content, for how to submit such a request.
4.2.1 enamorix.com holds full responsibility for all interactions between you and other users on our platform. This means that enamorix.com has a legal responsibility for all your interactions with other users. We are obligated to continuously monitor both content and communication to prevent the spread of illegal material and to prevent breaches of our terms of service. enamorix.com also reserves the right to intervene in and monitor any disputes between you and other users. Furthermore, we reserve the right to conduct criminal background checks among our members, for instance, to identify registered sex offenders. All content and information that you share with other users are carefully monitored. In case of a violation of our rules and terms, you agree to waive and release enamorix.com from all responsibility for any claims, disputes, or legal proceedings that have arisen as a result of your own actions. Examples of such actions include, but are not limited to, copyright infringement, unethical behavior, racially discriminatory actions, and harassment.
4.2.2 enamorix.com is responsible in accordance with applicable laws and regulations for the content that you, the user, upload to our platform. 4.3 enamorix.com assumes no responsibility for the malicious use of data provided by the user to third parties. enamorix.com is also not responsible for third-party unauthorized access to users' personal data (for example, through unauthorized access to the central database), unless enamorix.com knowingly or through gross negligence has made third-party unauthorized access possible.
4.4 enamorix.com is only liable (except for breach of essential contractual obligations), for injury to life, body or health or for claims under Bulgaria legislation or EU law - for intent and gross negligence. The term essential contractual obligations refers to those obligations whose fulfillment is mandatory in order to achieve the purpose of the agreement.
4.5 In case of minor negligence of essential contractual obligations that are necessary to achieve the purpose of the agreement, enamorix.com shall only be liable for losses that can be calculated and are typical for similar activities in the sector, according to paragraph 112 of the Bulgarian Consumer Protection Act and the Trade Regulation Act, BG/SG 96/14.03.2014.
4.6 The above limitation of liability also applies to the personal liability of employees, representatives and agents of enamorix.com
Payment services:

Virtual currency called "credits" are required on the website to chat, flirt, and access all the website's features. According to Bulgarian consumer protection legislation, users who purchase virtual currency on a website also have rights and protections under the Bulgarian law Consumer Protection Act and the Trade Regulation Act, BG/SG 96/14.03.2014. All prices displayed always include value-added tax and other government taxes in accordance with the Value Added Tax Act BG/SG 94/1.12.2006.

5.1.2 In order for the user to purchase "credits", the user will be redirected to an external payment provider to complete the purchase.
5.1.2 The credit charge for messages is tailored to reflect the length and thus the value of each communication: 50 credits for up to 100 characters, 75 credits for 101 to 200 characters, and 100 credits for 201 to 500 characters. This model is designed to encourage and reward clarity and precision in communication, while accommodating the need for more extensive expression when necessary. By adjusting the cost according to the length of the message, we aim to offer a more personal and fair pricing, enabling each user to express themselves in a way that best suits their individual needs and context
5.2 A user is entitled to a full refund within 14 days of the purchase, unless the user chooses to use any of the products purchased by the user. If this is the case, the right to a refund disappears. It is up to the user to inform enamorix.com that the purchase should be returned to the user.
5.2.1 In the event that a payment dispute between the user and enamorix.com arises/exists, the information provided by the owner is decisive in determining the actual amount, unless the user can demonstrate that the information referred to by the owner is incorrect.
5.3 According to Article 54 of the Bulgaria Consumer Protection Act and the Trade Regulation Act, BG/SG 96/14.03.2014, users who delete their account have the right to receive a refund of any prepaid amounts, but the user is not entitled to demand a refund of any "Credits" that have been purchased.
5.4 According to Article 56 of the CPA and TRA BG/SG 96/14.03.2014, the owner may charge the user additional costs if the user performs a chargeback without valid reason.
Disputes and complaints:
6.1 Given that the owner of the website is not involved in the communication between the users of the website, the owner disclaims any kind of responsibility or damages, both direct and indirect, in accordance with this agreement.
6.2 In the event of a complaint by the user of the website while using it, the owner of the website will take this as seriously as possible.
6.3 Complaints can and must only be made in writing by the user to the owner of the website.
6.4 It is up to the owner of the website to try to find a solution to the complaint as soon as possible.
6.5 If the User and the Owner cannot find a solution to the problem, the User can use the European Commission online dispute resolution portal https://ec.europa.eu/consumers/odr/main/?event=main.home2.show
6.6 These Terms of Use and all use/use of the Website and its Services are subject to and governed by the laws of Bulgaria. It is only in a Bulgaria court that any action with claims can be brought. Users agree that only general court in the jurisdiction of Bulgaria will have exclusive jurisdiction to adjudicate/decide/over any dispute arising out of or in any way related to these Terms or the Services.
Termination rules
7.1 According to Bulgaria's consumer protection legislation, you as a user have the right to cancel your membership at any time. You can cancel your membership from your user account. Note that terminated accounts will not be refunded for the unused portion of the current service, according to the Consumer Protection Act and the Trade Regulation Act, BG/SG 96/14.03.2014..
7.2 Upon termination of the agreement between the parties for any reason, the user's right to use the service is immediately terminated and access to the service is denied with immediate effect. Upon termination, the owner deletes the account and content made public by the user, except for the content that law or regulation requires the owner to save in order to fulfill its obligations. The owner is not obliged to provide the user with any material after the agreement has ended.
License, authorization and permission
8.1 The user guarantees that the content posted or created by the user, and its use on the website and service in general, does not violate third-party interests, especially not copyrights or other rights, in accordance with Bulgarian legislation.
Clause against class action
9.1 If the applicable jurisdiction for this Agreement permits (Section 6.6), class actions, inter-class arbitrations, private attorney actions and any other proceeding in which someone acts as a representative of a person are not permitted. Unless both User and enamorix.com agree, no arbitrator or judge may consolidate more than one person's claims or otherwise conduct any form of representative or class proceeding.
Intellectual property
10.1 All information available on the website is the owner of enamorix.com intellectual property or its licensors and thus may not be reproduced for private or commercial purposes under any circumstances.
10.2 Should the owner of the website be informed that a certain type of material on the website such as images, texts or links may be offensive in nature, the owner reserves the right to remove such content as soon as possible. However, there is no obligation for the owner to implement this unless it would be obvious that the material is of such a nature that there is no doubt that the material is offensive in nature.
Reporting and Removal of Content
11.1 enamorix.com has established a procedure whereby questionable illegal material or suspected criminal activity may be reported to the Owner. This can be done by sending a message to the following email address: support@enamorix.com
11.1.1 Every individual has the right to request the removal of images from the website if they are depicted without consent or in an illegal manner. When contacting us via email, you should include your profile information (username and email address) so we can verify that you are indeed the account holder with the authority to make changes to the account. You can also provide us with other relevant information necessary to identify the content in question as illegal or non-consensual. We meticulously monitor content around the clock and take actions to remove any violations, including content uploaded without consent, as well as to suspend accounts that do not adhere to our guidelines.
11.1.2 If you are aware of any illegal or non-consensual content on this website, you can immediately contact customer support via email, either through the contact form on the website or at support@enamorix.com. We will promptly investigate the matter and if illegal/non-consensual content is found, it will be removed within 24 hours. All complaints will be logged for documentation and reporting purposes.
11.1.3 If you wish to express your concerns or complain about the behavior of other users, the website's design, inadequate user support, or administrative issues, please specify information such as the user's name, design issues, or support problems and explain the nature of the problem to support@enamorix.com. We ensure that all complaints are handled in a fair and consistent manner, with the goal of resolving them to the complainant's satisfaction whenever possible within 7 days.
11.2 enamorix.com will under no circumstances be a direct party to a dispute between the applicant and a third party.
11.3 enamorix.com cooperates fully with law enforcement authorities in case of suspicion that illegal material has been uploaded and if illegal activity is/is taking place, such request is made by the competent authority in question with legal support.
11.4 enamorix.com reserves the right not to comply with a request to block material and stop certain activity, if enamorix.com has good reason to doubt the veracity of the notification or the legality of the supporting materials submitted. enamorix.com may in these cases require a court order from a competent court in Bulgaria, which judges whether the content or activity in question is manifestly illegal.
Violation of these Terms
12.1 If it is found that violation of these terms is/occurs, or other acts that are indifferent to the commission of a crime/fraudulent in nature, the owner of the website reserves the right to block the membership at the same time of the user without consent or omen. Outstanding "Credits" will thus be considered used up and non-refundable.
